Stop misleading the public, ex-VC's lawyer tells LAUTECH

By Debo Akinola
Lawyer to Lanrewaju Nassar, a professor of management and former Vice-Chancellor of Ladoke Akintola University of Technology, LAUTECH, Ogbomoso, Mr. Otaru Otaru, has described a public notice published by the authorities of the university last week as a calculated attempt to smear the good image and reputation of his client, as well a mockery of the judicial system.
In a statement made available to journalists via email, Mr. Otaru stated that contrary to the position of the said publications, "the Supreme Court did not nullify the appointment of Prof. Moshood Lanrewaju Nassar as Vice-Chancellor of Ladoke Akintola University of Technology (LAUTECH). His appointment was not an issue before the Supreme Court in that suit and the said appointment was not a unilateral appointment by the Oyo State Government but by the Governing Council of LAUTECH".
The management of LAUTECH had on Monday notified the public about the said Supreme Court judgement, stating that "In view of the Supreme Court decision in suit No: SC/235/2010 delivered on 20th March, 2012, nullifying the unilateral appointment of Prof. M.L. Nassar by Oyo State Government as the Vice-Chancellor, Ladoke Akintola University of Technology, Ogbomoso, Oyo State, Nigeria among others, and which nullification was communicated to Prof. M.L. Nassar vide letter with reference number Reg/Estab/SSA/PF.001 of 15/5g2012, it is hereby reiterated that the nullification of the said appointment still stands and relates to the 14th day of March, 2011 which is the date of commencement of the purported unilateral appointment as contained in the letter of appointment with ref. No. Reg/Estab/SSA/PF.004 of 15/3/2011".
The public notice also people against having anything to do with Prof. M.L. Nassar as the VC of the University.
Mr. Otaru observed that the said publication amounts to a gross misrepresentation of the facts and decision in Suit No: SC/235/2010 delivered on 26th March, 2012, saying that the Supreme Court didn't nullify the appointment of his client as VC of LAUTECH as Prof. Nassar's appointment was not an issue before the apex court in the suit.
“There is a pending suit at the National Industrial Court holden at Ibadan wherein Prof. Moshood Lanrewaju Nassar is challenging the unlawful suspension of his appointment as Vice Chancellor of LAUTECH before the expiration of his tenure under and by virtue of the relevant Laws, Rules and Regulations of the University...While the Supreme Court suit bordered on issues relating to the joint ownership of LAUTECH, the suit pending at the National Industrial Court, Ibadan is on the unlawful suspension of Prof. Moshod Lanrewaju Nassar,” the lawyer stated in his correspondence.
He, however, urged those concerned, particularly the Governing Council of LAUTECH, not to foist a 'fait accompli' upon the trial Court "as those who indulge in this naked exercise of assuming jurisdiction over the case instead of the Law Court(s) shall be cited for contempt of Court".
